As an essential principle in contract law, Indonesia has regulated good faith in the Indonesian Civil Code (the Dutch Civil Code that the Indonesian government uses based on the principle of concordance). However, the definition and benchmarks are not yet clear. There are no further provisions regarding the meaning and concept of this principle in the Indonesian Civil Code or other regulations. This absence of a single understanding of good faith principle in contract causes different opinions and legal certainty, whether from the business actor who signs the agreement or the judge as the third party who resolves contract disputes between parties. Therefore, future Indonesian contract law needs to regulate the definition and benchmarks for good faith principle. In order to find out the meaning and clear benchmarks for the good faith principle, the authors use a normative juridical method with a statute and conceptual approach. This research finds that the definition and benchmarks for the good faith principle is possible to be developed and regulated in Indonesian contract law. It shall set that good faith principle is based on honesty, decency, and fairness, which covers every agreement stage, from pre-agreement, agreement implementation, and after the agreement is completed.
Border cities face significant challenges due to political, environmental, and social issues. Strong urban governance can help resolve many of these problems, but it requires identifying practical factors specific to each city’s location. This study aimed to assess the state of urban governance in Paveh, a border city with a population of 25,771 people. The research used both primary data collection (through a questionnaire) and secondary data sources (local and national databases and documents). The study randomly selected 379 households from Paveh’s population and determined a reliability value of 0.913 using the Cochrane procedure. To assess Paveh’s urban governance, eight criteria were used: participatory, rule-of-law compliance, transparency, responsiveness, consensus-oriented, equitable and inclusive, effective and efficient, and accountability. The findings revealed that Paveh’s urban governance, particularly in the dimensions of transparency and participation, is in an unfavorable situation.
The present study aimed to determine the dynamic relationship between good governance, fiscal policy, and economic growth in Oman. In the context of the current study, researchers chose a quantitative approach to answer the research questions, utilizing the latest 2023 data from the World Bank and The Global Economy databases. The data for the current study was carefully selected using variables that represent aspects of governance, fiscal policies, and economic performance. Our analysis uses Ordinary Least Squares (OLS) regression and the Autoregressive Distributed Lag (ARDL) Model. These methods help us understand these factors’ immediate and long-term impacts on Oman’s economy. The results we obtained offer fascinating insights into the country’s economic dynamics. We observe bidirectional causal relationships between the Good Governance Index (GGI) and the Regulatory Quality Index (RQI) and economic growth, while Fiscal Policy Effectiveness (FPE), Government Efficiency Index (GEI), and the Rule of Law Index (RLI) exhibit unidirectional causality towards GDP. Budget Balance (BB) shows no causal relationship with GDP, implying external factors influence it. Additionally, moderation analysis underscores the significance of digital financial inclusion in amplifying the effects of governance and fiscal policies on economic growth. These findings hold practical implications for policymakers and stakeholders in Oman. Specifically, they highlight the importance of governance, regulatory quality, and effective fiscal policies in shaping the economic landscape. To foster sustainable economic development, efforts should improve governance, enhance fiscal policy effectiveness, and promote digital financial inclusion.
This paper investigates the innovation policy used by the Chinese government and tries to give recommendations to other developing countries to achieve leapfrogging. The main results are as follows: (1) summarize the main HSR-related policy theme issued by the Chinese government, mainly technology transfer, the communication and collaboration with different actors, and the state’s role, (2) discuss the existing challenges and issues for HSR policies, (3) give recommended measures for other developing countries.
